NOTICE OF SALE

Under and by virtue of the power and authority contained in the above-referenced deed of trust and because of default in the payment of the secured indebtedness and failure to perform the stipulation and agreements therein contained and, pursuant to demand of the owner and holder of the secured debt, the undersigned substitute trustee will expose for sale at public auction to the highest bidder for cash at the usual place of sale at the county courthouse of said county at 11:30AM on February 6, 2014 the following described real estate and any other improvements which may be situated thereon, in New Hanover County, North Carolina, and being more particularly described as follows:

TRACT ONE (1):

BEGINNING at an iron pipe on the East side of a ditch and is in the Northern line of a 30 foot right-of-way that leads from NC State Hwy to the Cape Fear Dairy Barns, and is also North 2 degrees 30 minutes West 30 feet from a stone located in the Southern line of said 30 foot right-of-way, and said stone is about 12 feet eastwardly from the center of the south end of a concrete bridge that crosses said 30 foot right-of-way; thence North 11 degrees 05 minutes East along a ditch 150.7 feet to a cross cut on the Southwest corner of a concrete bridge; thence South 75 degrees 48 minutes East 109.5 feet to an iron pipe; thence South 2 degrees 12 minutes West 133.6 feet to an iron pipe in the Northern line of said 30 foot right-of-way; thence North 84 degrees 30 minutes West along the Northern line of said right-of way 130.3 feet to the BEGINNING, the same being Lot No. 6 as shown on a map entitled “Swart’s Property Home Sites” as made by Lewis L. Merritt, C.E., and dated December 1943, which said map is recorded in the Office of the Register of Deeds of New Hanover County.

BEGINNING at the northwest corner of Lot No.6 of the Swart’s Property Home Sites as shown on the map thereof recorded in Map Book 7 at Page 89.of the New Hanover County Registry, said corner being marked by an “X” cut in the southwest corner of a concrete bridge; running thence from said beginning point North 5 degrees 42 minutes East 68.8 feet to an iron pipe; thence South 75 degrees 27 minutes: East, 105.8 feet. to an iron pipe; thence South 2 degrees 38 minutes West 69.5 feet to an old iron pipe marking the northeast;. corner of said Lot No. 6; thence North  75 degrees 27 minutes West in the northern line of said Lot No, 6 109.5 feet to the point of BEGINNING, containing 0.17 acre.

The record owner(s) of the property, as reflected on the records of the Register of Deeds, is/are Marko S. Bracy.

The property to be offered pursuant to this notice of sale is being offered for sale, transfer and conveyance “AS IS, WHERE IS.” Neither the Trustee nor the holder of the note secured by the deed of trust, being foreclosed, nor the officers, directors, attorneys, employees, agents or authorized representative of either Trustee or the holder of the note make any representation or warranty relating to the title or any physical, environmental, health or safety conditions existing in, on, at or relating to the property being offered for sale.  Any and all responsibilities or liabilities arising out of or in any way relating to any such condition expressly are disclaimed.  This sale is made subject to all prior liens and encumbrances, and unpaid taxes and assessments including but not limited to any transfer tax associated with the foreclosure.  A deposit of five percent (5%) of the amount of the bid or seven hundred fifty dollars ($750.00), whichever is greater, is required and must be tendered in the form of certified funds at the time of the sale.  This sale will be held open ten days for upset bids as required by law.
